2.4 Capacity to Contract

By registering an account, you represent that you possess the legal capacity to enter into binding contracts under Philippine law. You further warrant that you are not prohibited from gambling under any applicable law, court order, or agreement. If you are subject to any gambling restrictions or prohibitions, you must not use ph386 Services.

3. Account Registration and Security

3.1 Registration Requirements

To access ph386 gaming Services, you must register a personal account ("Account"). During registration, you must provide accurate, current, and complete information, including but not limited to your full legal name, date of birth, residential address, email address, and telephone number. You agree to maintain the accuracy of this information and promptly update it as necessary.

3.2 One Account Per Person

Multiple Accounts, duplicate Accounts, or Accounts opened under false identities are strictly prohibited. ph386 reserves the right to close duplicate Accounts without notice and to forfeit any funds or winnings associated with such Accounts.

You are solely responsible for maintaining the confidentiality of your Account login credentials (username and password). You agree not to disclose your credentials to any third party. You must immediately notify ph386 of any unauthorized use of your Account or any other breach of security. ph386 shall not be liable for any loss or damage arising from unauthorized Account access resulting from your failure to protect your credentials.

3.4 Account Verification

ph386 reserves the right to request verification documentation at any time, including but not limited to government-issued identification, proof of address, and proof of payment method ownership. Failure to provide requested documentation within the specified timeframe may result in Account suspension or closure.

3.5 Account Suspension and Termination

ph386 reserves the right to suspend, restrict, or terminate your Account at any time if you violate these Terms, engage in fraudulent activity, abuse bonuses, attempt to manipulate games or systems, or for any other reason determined by ph386 in its sole discretion. Upon termination, ph386 will refund any remaining Account balance minus any amounts owed to ph386, provided the Account closure was not due to fraudulent activity or Terms violations.

4. Deposits and Account Funding

4.1 Deposit Methods

ph386 accepts deposits via multiple payment methods, including but not limited to GCash, PayMaya, bank transfer, and other methods displayed on the Platform. All deposits must be made using payment methods registered in your own name. Third-party deposits are prohibited.

4.2 Minimum and Maximum Deposits

Deposit limits vary by payment method and are displayed on the deposit page. ph386 reserves the right to modify deposit limits at any time. You are solely responsible for ensuring that deposits do not exceed your personal financial means.

4.3 Currency

All transactions on ph386 are conducted in Philippine Pesos (PHP). Deposits made in other currencies may be subject to currency conversion at prevailing exchange rates, and conversion fees may apply.

4.4 Deposit Processing Time

Most deposit methods process instantly. However, processing times may vary depending on the payment provider. ph386 is not responsible for delays caused by third-party payment processors.

4.5 Responsible Deposit Limits

ph386 provides responsible gaming tools that allow you to set daily, weekly, or monthly deposit limits. Once set, deposit limits cannot be increased for a period of seven (7) days. Limit decreases take effect immediately.

5. Gaming Rules and Conduct

5.1 Game Integrity

5.3 Betting Limits

5.5 Player Conduct

6. Bonuses and Promotions

7. Withdrawals and Payment Processing

You may request withdrawal of funds from your Account balance at any time, subject to these Terms and any applicable Bonus terms. Withdrawals must be made using the same payment method used for deposits unless otherwise approved by ph386.

7.2 Verification Requirements

Before processing your first withdrawal, ph386 requires completion of Account verification procedures, including submission of government-issued identification and proof of address. Additional verification may be required for large withdrawals or as part of anti-money laundering procedures.

7.3 Withdrawal Processing Time

ph386 aims to process withdrawal requests within forty-eight (48) hours of receipt. However, processing times may vary depending on verification requirements and payment method. GCash and PayMaya withdrawals typically process within 24 hours. Bank transfers may take 3-5 business days.

7.4 Withdrawal Limits

Minimum and maximum withdrawal limits apply and vary by payment method. These limits are displayed on the withdrawal page. ph386 reserves the right to modify withdrawal limits at any time.

7.5 Anti-Money Laundering Compliance

ph386 is required to comply with Philippine anti-money laundering (AML) regulations. Suspicious transactions may be reported to relevant authorities. ph386 reserves the right to freeze Accounts and funds pending investigation of suspected money laundering activity.

8. Prohibited Activities

8.1 General Prohibitions

The following activities are strictly prohibited and constitute grounds for immediate Account termination, forfeiture of funds, and potential legal action:

• Opening multiple Accounts or allowing others to access your Account;
• Using ph386 Services from prohibited jurisdictions or through VPN, proxy, or other location-masking technology;
• Engaging in fraudulent activity, including use of stolen payment methods, false identification, or misrepresentation;
• Colluding with other players to gain unfair advantage;
• Using automated software, bots, or other tools to place bets or interact with ph386 systems;
• Exploiting software errors, bugs, or vulnerabilities for personal gain;
• Attempting to hack, reverse engineer, or interfere with ph386 systems;
• Abusing Bonuses or promotional offers as defined in Section 6.4;
• Money laundering or using ph386 for any illegal purpose;
• Harassing, threatening, or abusing ph386 staff or other players;
• Sharing, selling, or transferring your Account to third parties;
• Engaging in any activity that ph386 determines, in its sole discretion, to be unfair, abusive, or detrimental to ph386 or other players.

8.2 Consequences of Prohibited Activities

If you engage in any prohibited activity, ph386 reserves the right to: (i) immediately suspend or terminate your Account; (ii) void any pending bets, Bonuses, or winnings; (iii) forfeit your Account balance; (iv) report your activity to regulatory authorities and law enforcement; and (v) pursue legal action for damages.

9. Intellectual Property Rights

9.1 Ownership

All content, software, graphics, design, logos, trademarks, and other materials available on the ph386 Platform ("ph386 Content") are owned by ph386 or its licensors and are protected by Philippine and international intellectual property laws. The ph386 name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ph386.

9.2 Limited License

ph386 grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Services for personal, non-commercial entertainment purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any ph386 Content without prior written consent from ph386.

9.3 Third-Party Content

Games available on ph386 are provided by third-party game developers and are subject to those developers' intellectual property rights. Use of such games is subject to both these Terms and the developers' own terms and conditions.

10. Limitation of Liability

10.1 Disclaimer of Warranties

ph386 Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Philippine law, ph386 disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ph386 does not warrant that Services will be uninterrupted, error-free, or completely secure.

10.2 Limitation of Liability

To the maximum extent permitted by Philippine law, ph386 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or use, arising out of or related to your use of ph386 Services, even if ph386 has been advised of the possibility of such damages. ph386's total aggregate liability to you for all claims arising from or related to these Terms or ph386 Services shall not exceed the amount of deposits you made to your Account in the six (6) months preceding the claim.

10.3 Third-Party Services

ph386 is not responsible or liable for the actions, content, products, or services of third-party providers, including payment processors, game developers, and internet service providers. Your use of third-party services is at your own risk.

10.4 Force Majeure

ph386 shall not be liable for any failure to perform its obligations under these Terms where such failure results from circumstances beyond ph386's reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms and any disputes arising from or related to ph386 Services shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

11.2 PAGCOR Oversight

As a PAGCOR-licensed operator, ph386 is subject to PAGCOR regulatory oversight. PAGCOR has authority to investigate player complaints and enforce gaming regulations. Before pursuing legal action, players are encouraged to exhaust ph386's internal complaint procedures and PAGCOR's dispute resolution processes.

11.3 Internal Complaint Procedure

If you have a complaint regarding ph386 Services, you must first contact ph386 customer support at [email protected] with full details of your complaint. ph386 will investigate and respond within fourteen (14) business days. If you are dissatisfied with ph386's response, you may escalate your complaint to PAGCOR.

11.4 Jurisdiction and Venue

Subject to Section 11.2, any legal action arising from or related to these Terms must be brought in the courts of the Republic of the Philippines. You and ph386 consent to the exclusive jurisdiction and venue of such courts.

11.5 Class Action Waiver

To the maximum extent permitted by Philippine law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Changes to Terms

12.1 Right to Modify

ph386 reserves the right to modify, amend, or update these Terms at any time in its sole discretion. Changes will be effective upon posting to the Platform. The "Last Updated" date at the top of these Terms indicates when changes were last made.

12.2 Notice of Changes

Material changes to these Terms will be communicated to you via email notification or prominent notice on the Platform. Your continued use of ph386 Services following notice of changes constitutes your acceptance of the modified Terms.

12.3 Rejection of Changes

If you do not agree to modified Terms, you must immediately discontinue use of ph386 Services and close your Account. You may withdraw your Account balance in accordance with Section 7, provided you have not violated these Terms.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms, together with the Privacy Policy and any Additional Terms, constitute the entire agreement between you and ph386 regarding your use of the Services and supersede all prior agreements and understandings, whether written or oral.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

13.3 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. ph386's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your Account to any third party without ph386's prior written consent. ph386 may assign these Terms or delegate its obligations without restriction.

13.5 Survival

Provisions of these Terms that by their nature should survive termination of your Account or these Terms shall survive, including but not limited to Sections 9 (Intellectual Property), 10 (Limitation of Liability), and 11 (Dispute Resolution).

13.6 Language

These Terms are provided in English. In the event of any conflict between English and translated versions, the English version shall prevail.
